These Terms & Conditions ("Terms") govern your use of product.preview.nexus (the "Site"), operated by NEXUS RAYTEK PTY LTD (ABN 40 682 687 056) ("we", "us", "our"), and your registration for and attendance at events offered through the Site ("Events"). By using the Site or registering for an Event, you agree to these Terms. Please also read our Privacy Policy and Cookie Policy.
Part A — Use of the Site
Acceptable use
You may use the Site only for lawful purposes. You must not: interfere with or disrupt the Site or its security; attempt to gain unauthorised access to any systems or data; use automated means to scrape or harvest content or personal information from the Site; submit false, misleading or fraudulent information; or use the Site to transmit malicious code or unsolicited communications.
Intellectual property
The Site and its content — including text, graphics, logos, and the Nexus name and branding — are owned by or licensed to us and are protected by intellectual property laws. You may view and print content for your personal, non-commercial use in connection with an Event, but must not otherwise reproduce, modify, distribute or commercially exploit any Site content without our written permission.
Accuracy of information
We take reasonable care to keep information on the Site accurate and current, but the Site is provided on an "as is" basis and we do not warrant that it will be uninterrupted, error-free or free of harmful components. Event details (including speakers, program, venue and timing) are subject to change as described in Part B.
Links to other sites
The Site may contain links to third-party websites. We do not control and are not responsible for their content or privacy practices.
Part B — Event registration and attendance
Registration
Event registrations are subject to availability and any eligibility criteria stated on the Event page. When you register, you must provide accurate and complete information for each attendee. If you register other people as part of a group booking, you confirm you have their consent to provide their details and to accept these Terms on their behalf, and you should refer them to these Terms and our Privacy Policy.
Your registration is confirmed when we issue a confirmation email with your ticket. Each ticket and its QR code is personal to the named attendee and may not be transferred, resold or duplicated without our consent. We may refuse or cancel a registration where we reasonably believe it is fraudulent, breaches these Terms, or was made in error.
Cancellations and refunds
Where an Event is free of charge, you may cancel your registration at any time. If you can no longer attend, please cancel so your place can be offered to someone else.
Where a fee applies, the price, payment terms and any specific cancellation or refund conditions will be stated on the Event page. Unless stated otherwise on the Event page: cancellations received more than 14 days before the Event will receive a full refund; cancellations after that time are non-refundable but the registration may be transferred to a substitute attendee by contacting us before the Event. Nothing in these Terms limits your rights under the Australian Consumer Law.
Changes and cancellation by us
We may alter an Event's program, speakers, format or venue, or reschedule or cancel an Event, where reasonably necessary. If we materially change, reschedule or cancel an Event, we will notify registered attendees using the contact details provided at registration. If a paid Event is cancelled by us or rescheduled to a time you cannot attend, you will be entitled to a full refund of the registration fee; we are not otherwise responsible for costs you incur in connection with attending an Event (such as travel or accommodation), and we recommend you make flexible arrangements.
Attendee conduct
We want our Events to be safe, professional and welcoming. Attendees must comply with reasonable directions of our staff and venue staff, and with venue rules, and must not engage in disruptive, offensive, harassing or unsafe behaviour. We may refuse entry to, or remove from an Event, any person who breaches this clause, without refund.
Photography and filming
Events may be photographed or recorded by us or on our behalf, and imagery may be used in our marketing and communications. By attending, you consent to being incidentally included in such imagery. If you do not wish to appear, tell our staff at the Event and we will take reasonable steps to accommodate you and to exclude identifiable imagery of you on request to privacy@corp.nexus.
Liability
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other right that cannot lawfully be excluded. Subject to that: we exclude all other warranties, whether express or implied; and to the maximum extent permitted by law, our total liability to you in connection with the Site or an Event is limited to (for paid Events) the amount you paid to attend, or (for free Events and use of the Site) the resupply of the relevant services. We are not liable for indirect or consequential loss, or for loss arising from circumstances beyond our reasonable control.
You are responsible for your own belongings at an Event.
Part C — General
Privacy. Personal information collected through the Site and at Events is handled in accordance with our Privacy Policy.
Changes to these Terms. We may update these Terms from time to time. The version published on the Site at the time you register for an Event applies to that registration. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
Severability. If any provision of these Terms is invalid or unenforceable, it is severed and the remaining provisions continue in effect.
Governing law. These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia.
